Code of Conduct Policy Violations

PURPOSE: To ensure public order on CUNY campuses and protect persons and property from unlawful conduct.
AUTHORITY: Adopted under Section 6450 of the New York Education Law, which mandates rules for maintaining public order at educational institutions.
SCOPE: Applies to all persons on CUNY property, including students, faculty, staff, and visitors.


PROHIBITED CONDUCT:

  • Obstruction or disruption of teaching, research, administration, or other CUNY activities.
  • Unauthorized entry into or occupation of CUNY facilities.
  • Physical violence or threats of violence.
  • Theft or damage to property.
  • Possession of firearms or dangerous weapons without written authorization.
  • Use or possession of drugs or alcohol on campus (except as permitted by law).
  • Failure to comply with lawful directions of CUNY officials or law enforcement.

ENFORCEMENT:

  • Violators may be subject to disciplinary action, including suspension, expulsion, or termination.
  • Criminal prosecution may also be pursued where applicable.

DUE PROCESS:

  • Individuals accused of violating the policy are entitled to a hearing.
  • Hearings are conducted in accordance with CUNY procedures and applicable laws.

EMERGENCY POWERS:

  •  The Chancellor or college president may take immediate action to restore order, including temporary suspension of individuals.

COMMUNICATION:

  • The policy must be made available to all members of the CUNY community.
  • Updates or changes must be communicated promptly.
